Electronic Records and Signature Consent

ELECTRONIC RECORDS AND SIGNATURE CONSENT

Clubs HQ operates electronically. This consent lets us provide agreements, disclosures, notices, and records to you electronically, and lets you sign documents — including the Participant Waiver and Release of Liability — with an electronic signature.

Federal law (the E-SIGN Act, 15 U.S.C. § 7001) and state law require that we obtain your informed consent before doing this, and that we tell you the following.

1. What This Consent Covers

All records, agreements, and notices relating to your use of Clubs HQ, including:

  • The Master Terms of Service and all incorporated policies;
  • The Participant Waiver and Release of Liability;
  • Role-specific agreements (Coach, Organizer, Venue) and the Marketplace and Payment Terms;
  • Subscription disclosures, auto-renewal notices, renewal reminders, and price-change notices;
  • Receipts, invoices, refund notices, and tax documents;
  • Privacy notices, consent records, and any legally required disclosure; and
  • Account, safety, and service notices.

2. Your Right to Receive Paper Records

You have the right to receive any of these records on paper. To request a paper copy, email info@clubshq.us with the record and the mailing address. We provide paper copies free of charge. Requesting a paper copy does not withdraw this consent and does not affect the legal effect of a record you already signed electronically.

3. Your Right to Withdraw This Consent

You may withdraw this consent at any time by emailing info@clubshq.us with the subject "Withdraw E-Sign Consent," or through Account Settings → Communication Preferences.

Consequences of withdrawal:

  • Withdrawal is effective only after we have had a reasonable opportunity to act on it, and does not affect the validity of any record or signature made before then.
  • Most Platform features cannot function without electronic records. If you withdraw consent, we may be unable to provide the Platform, and we may suspend or close your account.
  • You will still receive legally required records, by mail, at the address you provide.
  • No fee is charged for withdrawing consent.

4. Scope of This Consent

This consent applies to all records described in Section 1 for the duration of your relationship with Clubs HQ, not to a single transaction. It also covers records relating to a minor for whom you are the consenting parent or guardian.

5. Keeping Your Contact Information Current

You must keep your email address current. Update it in Account Settings → Profile, or email info@clubshq.us.

We are not responsible for records you do not receive because your email address was out of date or because messages from us were filtered or blocked. Please add info@clubshq.us to your address book and to any allowlist your mail provider uses.

6. Hardware and Software You Need

To access and retain electronic records, you need:

  • A device with internet access;
  • A current version of a standard web browser (Chrome, Safari, Firefox, or Edge — current version or one prior) with cookies and JavaScript enabled;
  • A valid email address and an email application able to receive messages from us;
  • Software able to display PDF documents (such as a current PDF reader); and
  • The ability to print or electronically save records you wish to retain.

If these requirements change in a way that creates a material risk you could not access or retain your records, we will notify you and give you the opportunity to withdraw this consent without fee.

7. Retaining Your Records

We recommend you download or print records that matter to you. Copies of your agreements, signed waivers, and consent history are available at any time in Account Settings → Legal and Documents, where you can view and download every document you have accepted, with its version and the date you accepted it.

8. Your Electronic Signature

When you type your name, check a signature box, or click a button designated as a signature:

  • You are signing the document electronically;
  • Your electronic signature has the same legal effect as a handwritten signature;
  • You are agreeing that the document, and our records of it, may be used as evidence in any proceeding, and you will not contest its validity or enforceability solely because it is electronic; and
  • You confirm you are the person named and are authorized to sign, including where you sign as a parent or guardian.

We record, for each signature: the exact version and content hash of the document presented, the date and time, your IP address, your browser and device information, your account identifier, and the specific action you took. We retain this evidence as described in the Privacy Policy — for waivers, seven years, and for a minor's waiver, until seven years after the minor reaches the age of majority.

9. Confirming You Can Access Electronic Records

By checking the box below in this browser and on this device, you confirm you can access and read this disclosure in the format presented, and that you can save or print it.
